Hostile Takeover Attempt of LULAC — Sept. 2-3, 2022 Updates

LULAC is under attack, my friends. As posted previously, National LULAC experienced an attempted coup at its national convention on the island of Puerto Rico on July 30, 2022. My husband and I were there and witnessed this. It was no fun watching our 93-year-old civil rights organization with deep roots in Texas poised on the precipice of impending harm, possibly irreparable, had the Puerto Rican leadership associated with the Partido Nuevo Progresista (PNP) taken over. We're still not out of the woods.

Doing my best to keep folks updated as this is an evolving situation. I've combined three posts in one. All were written by Bernardo Uresti, Editor of the subscriber-only blog, the VOICE OF THE MAINLAND

The obvious problem is that, however unfortunate, a divided national office impacts the whole.

Beginning with 
the Texas Dream Act (House Bill 1403) on which Rep. Domingo Garcia led as a legislator in the Texas House—that is now the Federal DREAM Act—I, and so many others, have worked closely with him since 2001. He is an honest and honorable man and easily the most progressive leader LULAC has had in a good long while.

I should add that I have been a LULAC member for over 30 years and presently co-chair with Dr. Theresa Montaño its national Higher Education Committee on which my husband, Dr. Emilio Zamora—along with 15 other members—also serves. Our work continues regardless as there are pressing policy issues at hand in education that don't go away however embattled our organization. Thanks to President Garcia for representing well our interests as an organization and for fighting the good fight. 

May peace, justice, and a brighter future for LULAC prevail.

Dear LULAC Familia,


As you know from my recent communications, the health and future of LULAC is under threat because of an ongoing attempt at a hostile takeover by individuals who have created hundreds of unlawful local councils. This attempted takeover is nothing short of an effort to undermine LULAC’s core mission of protecting the voting rights and ensuring social justice for all of LULAC’s members – something we have been doing for nearly a century. This is an existential threat. As National President of LULAC, I have had to devote much of my time and attention to fending off this takeover. These efforts have included dealing with a restraining order from a Texas court that prevented an unlawful election from occurring at last July’s national convention in Puerto Rico. These efforts also include stepped up efforts on my part to supervise and manage the operations of LULAC, including attempting to oversee our financial operations and supervise the performance of our Chief Executive Officer, which are key parts of my job description.


Unfortunately, I have faced multiple internal obstacles in my attempts to protect the health and future of LULAC, including resistance from our CEO to obtaining information necessary to evaluate her job performance and also basic financial information that is fundamental to our operations, and that would shed additional light on the origins of the hostile takeover. Because of this resistance and for additional operational reasons, I recently visited LULAC’s offices in Washington, D.C. for the purpose of temporarily suspending the CEO for her insubordination and multiple allegations of misuse of her office, and to obtain financial and other information that I am clearly entitled to as President of the organization. I was accompanied by our former National President, two highly respected female LULAC leaders. To my surprise, when we attempted to enter LULAC’s offices on the second day of our visit, the CEO prevented us from entering, even going so far as attempting to enlist the police in her effort. As a result, the CEO obstructed us from obtaining the information that, as President, I must have to monitor the operations of our beloved organization.


If that were not enough, as many of you likely have read in social media, after our attempted visit to LULAC’s Washington, D.C. offices, the CEO initiated an “anti-stalking” proceeding against me personally in a local trial court, claiming that I had engaged in intimidating and threatening behavior toward her. She did not notify me that she had initiated the proceeding and did not give me the opportunity even to respond to the highly inaccurate affidavit she submitted to the court. Contrary to the suggestions in her affidavit, I never even spoke with the CEO during my visit to the Washington, D.C. offices and did absolutely nothing that any reasonable person could construe to be a threat or any form of intimidation. These facts are fully corroborated by the three LULAC representatives who accompanied me on that visit. plus video and witness testimony. However, based on the CEO’s inaccurate affidavit and without any notice to me or opportunity to respond, the trial court entered a temporary anti-stalking order. A full hearing on that order will take place on September 8, 2022, which will finally allow me to respond to the CEO’s false statements and to defend myself against her completely unjustified claims. I will not allow her to smear the good name and reputation of our beloved LULAC, in addition to myself.


I ask for your patience and trust and promise that LULAC will survive this attempt to undermine the causes of voting rights, economic opportunity, and social justice that have defined us for nearly a century. We will not let that happen, and I need your support. Please stand up for LULAC and let others know we are united as we have been for 93 years to protect our community. Please help us ensure that LULAC continues to represent the millions of Latinos across the United States. There can be no room for compromise on our principles; together, we will win justice.

Domingo Garcia Sues Sindy Benavides and Pablo

Domingo Garcia, the National President of LULAC, has sued, in a cross-claim action, Sindy Benavides and Pablo Martinez for Defamation, Libel, Slander, Defamation Per Se, Business Disparagement and Tortious Interference and Conspiracy to Defamation, Libel, Slander, Defamation Per Se, Business Disparagement and tortuous Interference and is seeking damages of $10,000,000.00, plus exemplary damages.

The petition gives the reader a clearer picture of the immediate events that led Sindy Benavides to file the anti-stalking complaint against the National President.

The CEO Sindy Benavides decided to carry out the PNP pro-statehood agenda as an inside agent in LULAC. She had steadily been working a strategy to shape the confrontation that came to be, locking the National President out of the LULAC office in Washington, D.C., filing the criminal stalking complaint, calling the police in D.C. to bar Domingo Garcia and his team from entering the LULAC office and then taking the full stalking file, distributing it to a LULAC network of over 35,000 email  contacts maintained in a listserv file and then send an email to the National LULAC Board asking that the National President be suspended from his National office.

The power play against Domingo Garcia is being played out in the LULAC National Executive  Committee and the LULAC National Institute. The Executive Committee consists of the national elected officers of LULAC. The chief conspiracy activists are Pablo Martinez and Linda Chavez. These two fuse the other members on the Committee to carry out the conspiracy that benefits the PNP in island Puerto Rico. As National President, Domingo Garcia suspended Sindy Benavides early August. Roger Rocha asked Domingo Garcia to allow him to reach out to Sindy Benavides to see if she would work out a peaceful exit from LULAC. Roger Rocha, being the Roger Rocha that we know in LULAC, brought Sindy Benavidez back into LULAC through the LNI. 

It turns out that Sindy Benavides works under contract with two LULAC entities, the LULAC National Organization, the LNO, the constitutional organization, and the LULAC National Institute, the LNI, the bylaws organization. The LNI is totally subservient to the LNO, that is, the LNO created the LNI. The LNI serves at the pleasure of the LNO.

Working in the LNI, the conspirators worked out a power play against the National President and against LULAC, the membership organization, the LNO organization. The power play was to bring Sindy Benavides back into LULAC through the LNI. Roger Rocha cannot fuse the other players on the LNI, that's the job of Pablo Maritinez and Linda Chavez. Pablo Martinez is the National Treasurer. Linda Chavez is the VP of the Southwest representing the 15 million Mexican Americans of the Southwest. Both were ardent supporters of the PNP candidate to takeover LULAC at the behest of the PNP in the LULAC National Convention in Puerto Rico. Linda Chavez will be barred from LULAC because she was expelled from LULAC in 2012 and was never brought back into LULAC in the manner prescribed by the Constitution. The conspirators called a special meeting of the LNI. The normal time for special meetings of the LNI is a 5 day notice. The notice for this meeting was one hour. They held the meeting and appointed Sindy Benavides back into LULAC, giving her the key to the LULAC office, the staff and the LULAC infrastructure, data and financial files included.

LULAC'ers on the mainland might tire of what is going on in LULAC at this time, but believe me, a hard follower of LULAC and the PNP agenda, the fight is a real fight. For the LULAC CEO to file the criminal complaint against the National President for acts that are associated with the the responsibilities of the National President, protecting LULAC from a foreign political party takeover of LULAC, locking out the National President, distributing the criminal complaint to the national LULAC social media platform and writing a letter to the National Board of LULAC to suspend the National President because the PNP did not get what it wanted in Puerto Rico because the National President TRO'ed the PNP from destroying LULAC, a blood, sweat, and tears 93 year old civil rights organization of the 50 million Mexican American community of the United States. This lawsuit is trying to right the brutal attack of PNP agents inside of LULAC. These conspirators are trying to destroy Domingo Garcia by any means possible.

This lawsuit is only a part of the effort to clean house. Every conspirator will be will get their blowback. The LNI will be reorganized and controlled by the LNO as should have been the case from its founding. Island Puerto Rico from the island will be barred form LULAC because all that the island has done to LULAC is to bring the banana republic politics of the island territorial state into LULAC. From 1993, the Puerto Rico journey into LULAC was headed to a nuclear event.

The only LULAC entity to protect LULAC in the long run is the National LULAC Board of Directors.

Again, speaking of the National Board, they were scheduled to meet in the last full week of October. The PNP conspirators on the Executive Committee put out a call to have the National Board meet during the first week of October. Sindy Benavides, the CEO agent of the PNP, emailed the National Board of the early meeting.

This fight will go on for a while. For Mexican American LULAC'ers on the mainland, the historical base of LULAC, we will just have to wait and see if the National Board has the spine to back the National President or are they going to allow the PNP to takeover LULAC.

The lawsuit is below. Read it carefully and read all of it. There are two affidavits at the end of the petition. They support the facts provided by the Domingo Garcia.

$10,000,000.00 is a lot of money. The money that flowed out of the takeover from the island or the liquor license that was sold in New Mexico will not cover that kind of money.

When the PNP and and their mainland conspirators picked a fight with the Mexican American LULAC'ers, they picked a fight with the wrong Mexicans.

 The two conspirators against the National President of LULAC, Pablo Martinez and Linda Chavez, are trying to lay out the date for the National LULAC Board to hear the impeachment arguments against Domingo Garcia, as early as possible in the two months that the National Board meets in the months of October through November.

They want to remove Domingo Garcia.

They could not get him elected out of office in Puerto Rico where the PNP plan for the takeover of Puerto Rico would take place, so they are in a hurry to do the PNP's dirty deed at the first opportunity. Sindy Benavides is a player in the meeting given that she is informing the National Board members of the meeting planned by Pablo Martinez and Linda Chavez for October 1, 2022.

The meeting was originally planned for the last week of October, which is a normal time for the first meeting of the National Board in the fall of each year. An expedited meeting seems a little out of the ordinary, but what is ordinary in the PNP strategy to take over LULAC.

Domingo Garcia is the only person that stand between to takeover of LULAC by agents of a foreign political party, the PNP.

For LULAC'ers on the mainland that are following this power play by Linda Chavez and Pablo Martinez, the Editor is asking you to wait for the next shoe to drop.

The smart LULAC'ers on the mainland, the heirs of the LULAC legacy handed over to them by the long list of founders of this civil rights organization, are going to have to weigh the arguments: do they listen to the PNP, Linda Chavez, Pablo Martinez and 370 councilios on the island who want to take LULAC  away from the Mexican American LULAC heirs who have or will this legacy of an organization continue its historic journey as a beacon for the 65 million Raza on the mainland?

Linda Chavez and Pablo Martinez do not run LULAC.

Their endless meddling with the elected National President of LULAC should have consequencies.

    I am One of the TRO plaintiffs… indeed we are under hostile attempt to take over. But, as our motto goes ‘One for all…all for one”! It’s not about Domingo Garcia … it’s about the League! Keeping it together! Our fire Father’s did not create LUKAC. just to be ‘yanked’ out of our arms! It was created by Mexican Americans for the fight against injustices! This here is one unjust attempt to break us diary to do whatever they want for their ‘political party’. We must support our current President! We must ensure that politics of the Island is MIT what we are fighting for! This is the battle of the ‘Boricuas’ and NOT LULACers!

    LULAC is NOT FOR sale! We have many great accomplishments! Roger Rocha left us broke… people have clue how much finances Mr. Garcia has ‘poured’ into LULAC to keep us afloat! He is a very caring & generous man and good for our organization.

    We must remember, (each of us) WHY We JOINED LULAC in the first place. Stand by THAT! No matter what the outcome…we cannot allow third parties to ruin our organization!

    We must continue to support our National LULAC President Domingo Garcia. He has lead our organization in the way our forefathers meant for it to be - if you know LULAC then you know that Linda Chavez was suspended from the league in 2012And that Roger Rocha is a crook- let us stand together for LULAC - for what it was founded - an organization FOR THE PEOPLE- for OUR civil rights - let us not go backwards 70+ years- our motto is ‘ All for one- one for all. As Raza we need to take control of OUR ORGANIZATION.

  6. No one is speaking against the great people of Puerto Rico, the Boricuas. The concern is with the attempted takeover by members of the political elite of Puerto Rico, members of the PNP. What LULAC thinks is good for Puerto Rico is one thing. Ethically speaking, however, it should not make the decision for statehood as this is a responsibility that appropriately lies in the hands of the people of Puerto Rico.
