Higher Ed Bills in the 2025 Texas Legislature—from Texas AAUP and Texas AFT, AFL-CIO—Updated April 23, 2025

I'm happy to simply be a conduit for this super helpful roster of bills that represent Texas AAUP and Texas AFT legislative priorities, bills about which to be concerned, and hopeful bills.

Please consider joining Texas AAUP-AFT to advocate for the freedom to learn, teach, and research, and here are several reasons to join. Below, we give a short introduction to higher ed in Texas, the Texas AAUP-AFT higher ed Legislative priorities, concerning higher ed bills, promising higher ed bills, and a list of higher ed bills filed. All bills have now been filed for this session.

A Short Introduction to Higher Education in Texas

Texas has 1.4M students and about 80,000 faculty in public higher education: [Ref]

74 community & technical colleges -- meet workforce development needs for Texas in skilled labor (e.g. plumbers, electricians, HVAC technicians, welders, and medical technicians) and prepare students for additional educational opportunities at universities

37 universities – give students the foundation to enter professional careers (e.g. business, community service, engineering government, journalism, law, nursing, STEM, and teaching) and develop innovative research ideas and technologies.

15 health institutions – provide medical treatment in all 254 counties in Texas, including half of the 22M clinical visits each year and 1 in 7 who seek hospital care in Texas. For example, MD Anderson Cancer Center is part of the UT System.

At these institutions, faculty help students develop the critical thinking, knowledge, skills, and professional networks for responsible citizenship and productive careers.

In 2024, Texas enrolled 1.56 million students, with more than 90% being at public institutions. [Ref] Two-year community colleges and four-year public universities enrolled about 675,000 students each in 2023, and health institutions enrolled 27,410. In addition, 500,000 dual credit high school students took college courses in 2024, with 93% at two-year public colleges and 7% at public four-year colleges. Among all Texas residents enrolled in college, 14.7% leave the state to attend school. [Ref]

According to a study by the National Science Foundation, State of Texas funding per full-time public higher education student dropped from $6,292 in 2002 to $5,541 in 2023 after adjusting for inflation.

Each public university and health institution is governed by one of the seven university systems whose governing boards are appointed by the Governor. There are also 50 community college districts whose governing boards are elected by the local community. The Texas Higher Education Coordinating Board coordinates higher ed activities among the six university systems and 50 community college districts.

Research expenditures by public institutions in fiscal year 2020 were $5.4B from federal ($3B), state ($1.4B), and private ($1B) sources. The public institutions with the largest research expenditures were The University of Texas MD Anderson Cancer Center ($1.2B), Texas A&M University ($1.1B), and The University of Texas at Austin ($0.9B) in fiscal year 2020.

Texas AAUP-AFT Higher Education Legislative Priorities

Higher Education Legislative Priorities for Texas AAUP-AFT include the following four items:

1. Freedom to Learn and Teach: Encouraging and protecting free inquiry, free expression, intellectual exploration, and open dissent.

Instructors have expertise in their discipline through advanced study, work experience, scholarly work, and lifelong learning. Exercising freedom of expression and other First Amendment Rights empowers instructors to help students develop the critical thinking, knowledge, training, and professional networks needed for successful careers. Students and instructors develop and disseminate new knowledge from all viewpoints, including conservative, moderate, liberal, and apolitical, without institutional censorship.

2. Scholarly Research and Creative Works: Removing barriers hindering researchers to win government and private grants.

SB 17 (88th Session) banned diversity, equity, and inclusion (DEI) employment practices. SB 17 exempts scholarly research and creative works, but neither bans nor exempts grants. Researchers at community colleges, universities, and health institutions are struggling to apply for and receive research funding even if the research is not related to DEI employment practices. This funding funds students to learn advanced skills, and is vital for Texas having the most Research 1 (16) and Research 2 (16) universities of any state:

R1: at least $50M/year in external research funding and award 70+ research doctorates/year.
R2: at least $5M/year in external research funding and award 20+ research doctorates/year.

At R1 institutions, 50% of the faculty are tenured or tenure-track vs. 41% for R2 institutions vs. 33% across all institutions. [Ref] For example, tenured faculty lead multi-site teams to compete for large federal grants, such as the $20M+ 10-year NSF Engineering Research Centers. Texas A&M, Texas Tech, UT El Paso, and UT Austin have these centers. Tenured faculty help institutions in many other ways. [Ref] See the next item.

3. Faculty Economic Security & Tenure: Upholding current tenure policies that recruit and retain workforce development instructors.

Tenure is earned after a six-year tenure-track probationary period of rigorous annual evaluations and a cumulative evaluation of teaching, research, and service. Due to long-term employment, tenure-track and tenured faculty bring the bulk of external research funding, support degrees and certificates, and serve in administrative and leadership roles. To support workforce development, Del Mar College recruits and retains Welding Faculty through tenured positions to compete with the much higher salaries in industry. Tenured faculty undergo peer-based performance review to foster academic professional development. Tenure and tenure-track positions grant faculty due process in dismissals. Non-tenure-track faculty typically receive one-year employment contracts which can be non-renewed without due process.

4. Faculty Senates and Other Advisory Faculty Bodies: Supporting faculty input to improve curriculum, teaching methods, research, and hiring decisions.

On campus, a Faculty Senate is the faculty body elected by faculty that provides a forum for communication among faculty, students, staff, and administration. This forum helps coordinate the division of labor among the four constituent groups to create environments and opportunities for learning and growth for students. Faculty Senates make recommendations to the President on how to foster the highest quality curriculum, teaching methods, research, and faculty, including removal of redundancy in the curriculum. Faculty Senates are a key safeguard for freedom of expression across campus including in learning, teaching, and research. The Faculty Senate and other Faculty Advisory Bodies work cooperatively with the administration in the approval of degrees and other credentials. On all matters, institutional approval resides with the president.

HIGHER EDUCATION BILLS OF CONCERN
Texas AAUP-AFT is following these higher ed bills among others due to concerns of infringement on freedom to learn, freedom to teach, freedom to research, tenure, and shared governance at public colleges, universities, health institutions, and other institutions of higher education:

Academic freedom, shared governance and due process: SB 37 / HB 4499 (Creighton / Shaheen) is an omnibus bill identified as a high-priority bill by the Lt. Gov. First, the bill consolidates curriculum decisions at a higher ed institution in the governing board of the community college district or university system. Courses in the core curriculum, required for Associate and Bachelors degrees, may not endorse specific public policies, ideologies, or legislation. Second, a governing board consolidates hiring and evaluation of all administrative positions at an institution, and can overturn any institutional decision. Third, a governing board authorizes a faculty senate at an institution; the president appoints half the faculty senators and all leadership positions; and only tenured faculty may serve. Faculty are excluded from grievance and faculty disciplinary processes. Fourth, the Office of Excellence in Higher Education is established to investigate matters of academic discourse at institutions of higher ed and refer findings to the Attorney General.

SB 37 essentially includes and goes beyond SB 452 (Middleton) on hiring academic department heads, SB 1489 (Bettencourt) on administrative takeover of the faculty senate, and HB 281 / SB 757 (Tepper / Middleton) on defunding and discontinuing academic programs.

Status: Heard by the Senate Committee on Education K-16 on March 20th. 25 gave oral public testimony, all against. 50 faculty also submitted written testimony, all against. Bill left pending in committee on March 20, 2025, and passed by the committee on a 7-1 vote along party lines on April 3, 2025. SB 37 is on the Senate Intent Calendar and will be debated by the Senate soon.

Shared governance: SB 452 (Middleton) gives Boards of Regents and Boards of Trustees the sole authority to appoint heads of academic departments. This overrides shared governance between the faculty and the administration of the college or university.

Status: Heard by the Senate Committee on Education K-16 on March 20, 2025. At the hearing, 25 people gave oral public testimony, all against. 50 also submitted written testimony, all against. Bill left pending in committee.

Shared governance: SB 1489 (Bettencourt) requires that Faculty Senates must be authorized by the Board of Regents. Members are elected by the General Faculty or Colleges and Schools. A Faculty Senate is advisory only, reports to President, and may not conduct an investigation. All meetings are public meetings, and all votes recorded. Institution shall make the decisions on degree and curriculum matters under direction of the institution’s governing board.

Freedom to learn, due process, tenure & shared governance: HB 281 / SB 757 (Tepper / Middleton) defunds / discontinues academic programs if the median salaries do not exceed student loan debt 2 years (BS), 3 years (MS), and 5 years (doctoral) after graduation.

Status: SB 757 was heard April 3, 2025, by the Senate Committee on Education K-16. HB 281 has been referred to the and House Committee Higher Education.

Freedom to teach and shared governance: SB 530 / HB 1705 (Sparks / Shofner) and SB 1322 / HB 1870 (Hagenbush / Leo-Wilson) remove the Southern Association of Colleges and Schools as the sole accrediting agency for public and private colleges and universities (except for law and medical schools). SACS evaluates the procedures and policies to ensure freedom to teach and shared governance.

Status: HB 1705 was heard by the House Committee on Higher Education on April 1, 2025, and SB 530 will be heard April 3, 2025, by the Senate Committee on Education K-16. SB 1322 / HB 1870 referred to the Senate Committee on Education K-16 and House Committee Higher Education.

Freedom to learn, freedom to teach, and freedom to research: Texas SB 17 / HB 17 would effectively ban citizens of China, Iran, North Korea, and Russia from living in Texas by prohibiting them from buying or renting a place to live. The bill empowers the Governor to add other countries to the banned list.

Request: Amend HB 17 to exempt individuals. There are over 200,000 students, faculty, and other professionals in Texas who are immigrants from China, Iran, North Korea, and Russia, esp. in STEM fields.

Website: Stop Racist HB17 - Protect Immigrant Rights

Status: SB 17 passed the Senate. It was heard by the House Committee on Homeland Security, Public Safety and Veterans Affairs on April 2, 2025. The committee chair and bill author, Rep. Cole Hefner, filed an amended version (committee substitute). The committee is expected to approve the committee substitute at their meeting on April 9, 2025.

Freedom to learn: HB 2548 (Harris) bans the teaching of dozens of topics related to gender, racism, ethnicity, equity, and social justice in any course required for a program or degree requirement. Banned topics include those in contemporary American society related to critical theory, whiteness, systemic racism, institutional racism, anti-racism, microaggressions, ..., and differential treatment of any individual or group of individuals based on race or ethnicity. Also banned are topics related to the idea that racially neutral or colorblind laws, policies, or institutions perpetuate oppression, injustice, race-based privilege, ..., and that a student is biased on account of the student’s race or sex.

Status: Referred to House Committee Higher Education.

Freedom to learn, teach, and research: HB 2311 (Harrison) alters SB 17 from the last Legislative session. In the last Legislative session, SB 17 prohibits certain diversity, equity, and inclusion programs and practices at public colleges and universities. HB 2311 removes several exemptions in SB 17 including academic course instruction and scholarly research and creative works.

Status: Referred to House Committee Higher Education.

Freedom to learn: HB 2339 (Harrison) forbids public colleges and universities from offering a course, certificate, or degree program (1) in lesbian, gay, bisexual, transgender, or queer studies or (2) diversity, equity, and inclusion. Penalties for an employee include leave without pay for one year on the first violation and dismissal on the second violation. For any violation, the employee may not be hired at a public college or university in Texas.

Status: Referred to House Committee Higher Education.

Tenure: HB 1830 (Shaheen) bans future offerings of tenure of similar intent as the original version of SB 18 from the previous Legislative session.

Status: Referred to House Committee Higher Education.

PROMISING HIGHER EDUCATION BILLS

Texas AAUP-AFT recognizes the following bills as “encouraging legislation” for public institutions of higher education:

Freedom of expression: HB 393 (Bucy) / (Reynolds) repeals SB 17 from the last session. HB 4277 (Howard) adds an exemption to SB 17 to the last session to allow faculty and staff to provide information or guidance on career opportunities and grant applications.

Research grants: HB 184 (Guillen) and SB 580 (West) adds an exemption to SB 17 from the last session for research grants. HB 4277 (Howard) adds an exemption to SB 17 from the last session for applying for and receiving research grants funded wholly or in part by government or private grants.

Learning and working environments: SB 187 (Menéndez) requires that a public higher ed institution must have an Internet site and a hotline to report discrimination and harassment based on race, color, or ethnicity (appears to be a response to SB 17 from the last session)

Paid parental leave: SB 48 (Howard) adds certain state employees in higher ed to be eligible for eight weeks of paid leave on the birth or adoption of a child.

Economic security: HB 237 / SB 572 (Bucy / Eckhardt & Zaffirini) raises the pay by $10,000 for all higher education employees. In the last session, all state employees received raises except K-12 educators and higher education employees.

Student services: HB 4345 exempts certain requirements regarding diversity, equity, or inclusion initiatives for certain activities for veterans or persons with disabilities provided by public institutions

Student learning. HB 1330 / SB 365 (Howard / Eckhardt, Cook, Flores, Menéndez, Parker) allow a student to have an academic Fresh Start.

Student learning. HB 2321 / SB 1191 (Caroline Harris Davila / Creighton) align the GPA points for Dual Credit and Advanced Placement courses.

Student learning. SB 709 (Eckhardt) provides a sales tax exemption for textbook purchases.

Student financial aid. HB 936 (Jolanda Jones) allows student athletes to retain their athletic scholarships in the case of injury, illness, or disability

Student financial aid. SB 44 (Zaffirini) creates a Texas student loan program.

Student civic participation. HB 1003 (Zweiner) allows student IDs to be an acceptable ID for the purposes of voting.

The Texas Senate has announced their intention to file bills to regulate faculty senates and limit the teaching of ethnic, cultural, and gender studies in the first wave and second wave of their Interim Charges, and the Lt. Gov. tweeted on January 14, 2025, that an anti-CRT bill will be forthcoming.

In his State of the State Address on February 2, 2025, Gov. Abbott issued seven emergency legislative items. None of the emergency items appears to be related to higher education, with a possible exception of Career and Technical Education. On Career and Technical Education, Gov. Abbott's remarks were focused on K-12 education. Gov. Abbott mentioned his higher ed priorities: (1) prohibit professors from having any say over employment decisions and (2) expand the ban on DEI in our public universities.

Relating to the enrollment, including resident status and tuition rates, of certain persons, including persons not authorized to be present in the United States, in public institutions of higher education.

HB 167 Carl Tepper (R)

Relating to the implementation of diversity, equity, and inclusion initiatives and certain prohibited considerations in contracting by governmental entities.

HB 173 Giovanni Capriglione (R)

Relating to prohibiting public institutions of higher education from soliciting or accepting gifts, grants, or donations from certain foreign countries.

HB 181 Suleman Lulani (D)

Relating to a requirement that public institutions of higher education provide applicants with certain information regarding eligibility for public health programs.
